Microcredential and Micro Program Terms & Conditions

    1. Agreement

    These terms and conditions (Terms) are a binding legal agreement between you and Macquarie University (ABN 90 952 801 237, CRICOS Provider No: 00002J), of Balaclava Rd, North Ryde, NSW Australia 2109 (University, us or we) (together, the parties or a party) and apply to the provision of a Microcredential or Micro Program (together, referred to as a Credentialled Offering) provided to you by the University.

    2. Defined terms

    The following definitions apply in these Terms:

    1. Award Course means a program of learning that leads to the award of a qualification, such as diplomas, degrees and doctorates, approved by the Macquarie University Academic Senate.
    2. Credentialled Offering means a Microcredential or Micro-Program.
    3. Fees means any fees and charges the University advises are to be paid by you to enrol, and participate in, a Credentialled Offering.
    4. Key Requirements means the essential activities, capacities and academic requirements associated with the Credentialled Offering.
    5. Microcredential means a form of learning offered by the University, and on successful completion, a certification that is awarded that evidences your discrete learning and achievements.
    6. Micro Program means a structured compilation of Microcredentials with stipulated learning outcomes and associated assessments to assure the attainment of learning outcomes.

    3. Not a Macquarie University student

    1. You will not be a student of the University as a result of enrolling, participating in, or completing a Credentialled Offering. Among other things, this means you will not be supplied with a University email address, and you will not be entitled to access any benefits provided to students of the University (such as library access or personal accident insurance). You will, however, be required to comply with all applicable laws and applicable University policies.

    4. Enrolment and Payment

    1. The Fees are as listed on the University web page for the Credentialled Offering. Your enrolment is not complete and your position in the Credentialled Offering is not secure until you have paid the Fees in full.
    2. Payment for a Credentialled Offering is due at the time of registration for the Credentialled Offering.

    5. Your obligations

    1. You acknowledge and agree that:
      1. you fulfil all prerequisites (if any) for entry into, and participation in, the Credentialled Offering, as advised by the University through the web page and/or learning management system for the Credentialled Offering;
      2. you have read and understood the information pertaining to the Credentialled Offering you have chosen, available on the web page for the Credentialled Offering;
      3. you will be able to undertake the Key Requirements (if any) of the Credentialled Offering, as advised by the University through the web page for the Credentialled Offering;
      4. the Fees do not include equipment or materials required (for example, a computer, software or internet access), or any travel or other personal expenses incurred, through participation in the Credentialled Offering; you are required to complete the Credentialled Offering (and any assessments) in the timeframe advised by the University; and you will provide a valid email address to the University (and will notify us of any change to your email address); and the University will communicate with you by way of e-mail.
    1. You also agree:
      1. to provide accurate and complete information to the University at all times;
      2. to abide by the University’s lawful and reasonable directions, in particular those directions relating to work health and safety;
      3. to behave with honesty, integrity, and respect while participating in the Credentialled Offering, and in all dealings with the University and its staff, students, other participants in the Credentialled Offering and the general University community; and
      4. to maintain a satisfactory standard of academic integrity in the participation and completion of any Credentialled Offering undertaken by you in accordance with the Academic Integrity Policy.
    1. If:
      1. you breach any of these Terms: or
      2. in the University’s reasonable opinion, you engage in any conduct that is disruptive, harmful, brings the University into disrepute, or is otherwise unacceptable to the University,
    2. then:
      1. we may suspend or cancel your enrolment in a Credentialled Offering;
      2. we may suspend you from the University permanently or for a period of time which, if you are enrolled in an Award Course, may impact on that enrolment. This includes suspension both from the University campus and remotely;
      3. you may not be permitted to enrol in any future Credentialled Offering (s) or Award Course(s);
      4. you may be subject to other reasonable disciplinary action determined by the University pursuant to applicable University policies and procedures; and/or
      5. if a digital credential has been awarded to you for the Credentialled Offering to which the breach relates, we may revoke or cancel the digital credential.
      6. In all cases above, you acknowledge that you will not receive a refund (whether in full or in part) of any Fees paid by you

    6. Completion of a Credentialled Offering

    1. On successful completion of the Credentialled Offering, and provided you are not in breach of these Terms, you will receive a digital credential.
    2. You acknowledge and agree that the digital credential may be offered through a third-party provider, who may request that you agree to that providers’ privacy policy and terms of use.

    7. Recognition of prior learning

    1. Unless otherwise agreed by the University, completion of a Credentialled Offering will not be recognised as credit towards an Award Course, or for facilitating entry to an Award Course. The University has sole discretion to decide whether completion of a Credentialled Offering will be recognised for credit towards an Award Course, or for facilitating entry to an Award Course.
    2. In exercising its discretion, the University will refer to the University’s Recognition of Prior Learning Policy (available here, as amended or replaced from time to time), the requirements of the Award Course, and other relevant matters, such as when the Credentialled Offering was completed.

    8. Refunds

    1. If you wish to withdraw or cancel your participation in a Credentialled Offering, you must e-mail microcredentials@mq.edu.au (Notice).
    2. Unless otherwise advised by the University through the web page and/or learning management system for the Credentialled Offering, if the Notice is received by the University:
    3. more than 10 days prior to the Credentialled Offering commencement date, we will refund you 100% of the Fees already paid by you; or
    4. less than 10 days prior to the Credentialled Offering commencement date, no refund of the Fees will be given.
    5. No refund will be given to you if the Credentialled Offering is self-paced, and the University has given you access to the Course Materials.
    6. No refund will be given to you if you do not complete the Credentialled Offering in the time period prescribed by the University for completion (unless extended with the University’s permission).

    9. Reschedule or Transfer

    1. The University may re-schedule a Credentialled Offering at its discretion if unexpected circumstances arise (for example, due to Covid-19 or a natural disaster). In these circumstances, if you are unable to participate in the re-scheduled date(s), the University will refund you any Fees already paid.
    2. If you no longer wish to attend in your enrolled Credentialled Offering, at the University’s sole discretion, you may within 10 days of the commencement date, transfer your enrolment to another Credentialled Offering provided you meet the Key Requirements and there are places available. If there is a difference in the Fees any surplus will be refunded to you and any deficit will be payable by you, as applicable.

    10. Cancellations

    1. The University may cancel a Credentialled Offering at any time before the commencement of the Credentialled Offering, including if a minimum number of participants is not reached.
    2. The University will provide you with as much notice as possible of the cancellation. In the event of a cancellation, you may:
    3. transfer into the next scheduled Credentialled Offering of the same description (provided there are places available); or
    4. transfer into another Credentialled Offering (providing you meet the Key Requirements and there are places available); or
    5. receive a refund of the Fees already paid.
    6. To the extent permitted by law, the University will not be liable for any costs, expenses or losses incurred by you arising out of, or related to, the cancellation of a Credentialled Offering.

    11. Warranties

    You agree that you:

    1. have read, understood, and will comply with these Terms; and
    2. will comply with all applicable University policies and procedures, and in particular the:
      1. Acceptable use of Information Technology Resources Policy, and
      2. Academic Integrity Policy,

    as amended or replaced from time to time and which, for the purpose of these Terms only, a reference to a Student in these policies is taken to be a reference to you.

    12. Privacy

    1. You agree that:
    2. we will collect, store, and use your personal information:
    3. in accordance with the University’s privacy policy and privacy management plan, as amended or replaced from time to time);
    4. in accordance with the privacy statement provided to you with these Terms; and
    5. as specified in these Terms;
    6. we may disclose your personal information to third parties who assist in the delivery of the Credentialled Offering; and
    7. we may disclose your personal information to third parties who facilitate the provision of a digital credential. This may include third party hosting arrangements that store information outside Australia.

    13. Complaints

    1. Any complaint about a Credentialled Offering should be raised and dealt with in accordance with the Complaint Resolution Procedure for Students and Members of the Public (as amended or replaced from time to time).
    2. Academic misconduct will be managed in line with the arrangements and principles covered by the Academic Integrity Policy.

    14. Intellectual Property

    1. Course materials may be provided to you as part of undertaking a Credentialled Offering at the University (Course Materials).
    2. You acknowledge and agree that all right, title and interest (including intellectual property rights) in the Course Materials vest in and remain the property of the University, its licensors and any nominated third party (as noted on the Course Materials) at all times.
    3. You must not reproduce or communicate any part of the Course Materials or assessments (where applicable) in any manner without our prior written consent.
    4. Access to the Credentialled Offering, and Course Materials, will terminate 12 months from enrolment in the Credentialled Offering.

    15. General

    1. To the extent of any inconsistency between these Terms and the terms and conditions which specifically relate to a particular Credentialled Offering, as communicated to you by the University (Specific Terms) at the time of your enrolment, the Specific Terms will prevail.
    2. To the extent permitted by law, the University will not be liable for any costs, expenses or losses incurred by you arising out of, or related to, your enrolment or participation in a Credentialled Offering.
    3. These Terms may be altered, varied, or replaced by the University from time to time, in its sole discretion. We will give you 7 days' notice of any such alteration, variation, or replacement, at which time you will have 14 days to notify us of your intention to terminate this agreement and, if you have not yet attended your Credentialled Offering you will receive a full refund of the Fees paid.
    4. These Terms are governed by the laws of New South Wales and the parties submit to the non-exclusive jurisdiction of the Courts of New South Wales, Australia.
